General Sales Conditions
Bauthe is delighted to welcome you to its online boutique. These General Sales Conditions govern all sales of products made through the website bauthe.com to clients located in the United States. They define the rights and obligations of Bauthe and of the client in connection with an order. By placing an order, you confirm that you have read and accepted these General Sales Conditions, which prevail over any other document.
The products are sold by Bauthe. For any question relating to your order, our Client Advisors are at your disposal by email at hello@bauthe.com or by telephone at + (330) 324-6442, Monday to Saturday. These conditions may be amended at any time; the conditions applicable to your order are those in force on the date your order is placed, which we invite you to save or print.
The website is reserved for private individuals of at least eighteen years of age, acting for their personal needs and not for resale. Bauthe reserves the right to refuse or cancel any order that appears to be placed for commercial purposes, any order of abnormal quantity, or any order from a client with whom a dispute exists in relation to a previous order.
Bauthe offers a curated selection of fragrance, makeup, skincare, hair care, bath and body products and accessories. Every product sold on the website is authentic and comes directly from the brand or its authorised distributor. The essential characteristics of each product are described on its product page. Photographs are as faithful as possible, but variations in colour may occur depending on your screen settings. We recommend that you read the list of ingredients and the instructions for use before using any product.
Products are offered while stocks last. Should a product become unavailable after your order has been placed, Bauthe will inform you as soon as possible and you will be refunded for the unavailable item without delay. Bauthe may limit the quantity of certain products that can be purchased per order, in particular for limited editions and new launches.
Prices are indicated in US dollars and do not include delivery charges or applicable sales tax, which are calculated and displayed before you confirm your order. Where a comparison price is shown crossed out next to a product, it refers to a reference price for information purposes. Bauthe reserves the right to change its prices at any time; products will, however, be invoiced at the price in force when your order is confirmed. In the event of an obvious pricing error, Bauthe reserves the right to cancel the order and will inform you accordingly.
To place an order, select your products and add them to your bag, review the contents of your bag, enter or confirm your delivery address, choose your delivery method and payment method, then accept these General Sales Conditions and confirm your order. Before final confirmation, you may review the details of your order and correct any errors. Your order is only definitive once payment has been authorised.
Bauthe will send you an email acknowledging receipt of your order, followed by a confirmation once it has been accepted and dispatched. The contract of sale is formed upon dispatch. Bauthe reserves the right to cancel any order in the event of non-payment, suspected fraud or incomplete information, and will inform you if this occurs.
Payment is due in full at the time of ordering. Bauthe accepts major credit and debit cards, Apple Pay, Google Pay, PayPal and Bauthe gift cards. Your card is charged when your order is dispatched. All transactions are processed through secure, encrypted payment platforms, and Bauthe never has access to your full card details. Bauthe may carry out fraud checks and request additional documents before accepting an order.
Products are delivered to the address indicated at the time of ordering, within the United States, under the conditions set out on our Delivery and Returns page. Delivery times are given for information purposes and run from the dispatch of your order. Ownership of the products passes to you upon full payment, and the risk of loss or damage passes to you upon delivery.
Upon delivery, we invite you to check the condition of your parcel and its contents. Any missing product, error or damage must be reported to our Client Advisors within forty-eight hours of delivery, with photographs where possible, so that we may find the best solution for you.
You may return products within fourteen days of delivery, provided that they are unused, unopened, in their original packaging with their seals intact, and accompanied by proof of purchase. For reasons of hygiene and safety, certain products cannot be returned once opened. The full return procedure is described on our Delivery and Returns page. Refunds are made to the original method of payment within five to ten business days of receipt and inspection of the returned products.
Products sold by Bauthe benefit from all warranties provided by applicable law, including the implied warranty of merchantability. Should a product be defective or not conform to its description, please contact our Client Advisors, who will arrange its replacement or refund. Bauthe shall not be liable for damage resulting from misuse of a product, failure to follow its instructions, or a reaction due to a sensitivity of which the client was aware.
Bauthe shall not be liable for any failure or delay in the performance of its obligations resulting from an event of force majeure, such as natural disasters, epidemics, strikes, disruption of transport or telecommunications, or decisions of public authorities. The personal information collected when you place an order is processed in accordance with our Privacy Notice.
These General Sales Conditions are governed by the laws of the State of New York. In the event of any difficulty, we invite you first to contact our Client Advisors by email at hello@bauthe.com or by telephone at + (330) 324-6442, Monday to Saturday, in order to find an amicable solution. Failing agreement, any dispute shall be submitted to the competent courts of the State of New York, without prejudice to the mandatory rights you enjoy as a consumer in your state of residence.
